Soil and Environment and Planning Act

If you want to carry out activities on or in the soil, you will have to comply with the rules in the Environmental Act. Many activities fall under environmentally harmful activities, such as remediation of the soil. In addition, there are also rules when digging and applying soil. Remediation

The rules for excavating or covering contaminated soil are contained in the Environmental Act. Known contaminated locations fall under transitional law in a number of situations. The Soil Protection Act continues to apply here.

Transitional justice location

Locations with a use restriction (WKPB) are subject to transitional law. Heavily contaminated locations with ongoing soil remediation are also handled using existing procedures under the Soil Management Act. The Soil Supplementary Act explains what transitional law locations are. If this is the case, please send the report to the City of Leeuwarden.

Report remediation at transitional legal location

You do this via a BUS registration. You make this BUS registration yourself or the environmental consultancy firm.

Remediation plan

In special situations you must submit a remediation plan to the municipality. This plan must have been made by an environmental consulting firm. You will hear within 15 weeks whether the plan has been approved.

During soil remediation

You need to report the following situations using the form ‘Notification of start, end and change (PDF, 521.97 KB)‘:

  • Start and end date of remediation.
  • Reaching the final excavation depth.
  • Changes to and departures from the remediation plan.

Send the form to the City of Leeuwarden. You can also hand it in at the Town Hall.

After soil remediation

After soil remediation, you must submit an evaluation form. Send the form to the City of Leeuwarden. You can also hand it in at the Town Hall.
